1. Acceptance
The ccqta.com website (the “Website”) is operated and owned by The Canadian Crude Quality Technical Association (CCQTA). This page states the Terms of Use under which you may access and use the Website and the information and other content on the Website, including without limitation, articles, text, photographs, images, illustrations, (collectively the “Content”). By accessing this Website and accessing or using the Content you and the business entity which you represent (collectively “you”) are agreeing to be bound by these Terms of Use. If you do not accept these Terms of Use, do not use the Website or Content. CCQTA may revise these Terms of Use at any time by updating this posting. You must visit this page each time you visit the Website to review the Terms of Use because they are binding on you.
2. Intellectual Property Rights
The Website and Content are protected by applicable copyright, trademark, patent and other intellectual property laws under both Canadian and foreign laws which may be violated by unauthorized use of the Website or Content. Except as granted in the limited license herein, any use of the Website and Content, including any modification, transmission, presentation, distribution, republication, or other exploitation of the Website or the Content, whether in whole or in part, is prohibited, without the express prior written consent of CCQTA. You must retain all copyright, trademark, patent or other proprietary notices contained in the Content and on any copy you make of the Content.
3. Limited License
You are granted a limited, non-transferable and non-exclusive license to access, view and use the Website and Content for your personal, internal, noncommercial purposes. You shall use the Website and Content in accordance with these Terms of Use, which may be modified from time to time. You may download, store and print single copies of items comprising the Content for your personal, internal, non-commercial purposes. All other use of the Website or Content is prohibited. All rights not expressly granted herein are reserved. You may not sell, offer for sale, reproduce, display, publicly perform, distribute, or otherwise use the Content in any way not expressly permitted by these Terms of Use or for any public or commercial purpose, without the prior written consent of CCQTA or the third party to which the intellectual property rights belong. You shall not reverse engineer, decompile, decrypt, disassemble, or otherwise reduce the software included on the Website to human readable form, except to the extent otherwise expressly permitted under applicable law notwithstanding this restriction. If you violate any provision of these Terms of Use, your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any Content.
4. Confidentiality/Disclaimer
The Content is the confidential information of CCQTA and you agree to maintain the confidentiality of the Content, and not disclose the Content to any third party without CCQTA’s prior written consent.
CCQTA shall not be responsible for any threatening, defamatory, obscene, offensive or illegal content or conduct of any person. Notwithstanding anything else in this Terms of Use Agreement, you acknowledge that when using the Website, information will be transmitted over a medium that is beyond the control and jurisdiction of CCQTA. Accordingly, CCQTA assumes no liability whatsoever for the delay, failure, interruption, corruption or interception of any data transmitted through the Website. The views and opinions expressed in certain comments or blogs or links on the Website may not reflect the views or opinions of CCQTA.
5. Disclaimer of Warranties
The Website and the Content is provided “as is” without any representations, warranties or conditions of any kind, express of implied, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose or use, title or non-infringement. No representations or warranties are made concerning the accuracy, completeness, timeliness or reliability of the Website or Content. Further, CCQTA makes no representations or warranty that (I) The Website or Content will be accurate, complete, current, reliable, or timely, (II) that the operation of the Website will be uninterrupted or error-free, (III) that defects or errors in the Website or the Content, be it human or computer errors, will be corrected, (IV) that the Website will be free from viruses or harmful components, and (V) that communications to or from the Website will be secure and/or not intercepted.
6. Limitation of Liability
In no event shall CCQTA, its officers, directors, employees, affiliates, agents, licensors, suppliers and assigns (collectively its “representatives”) be liable to you or any third party for any direct, indirect, incidental, special or consequential damages or losses whatsoever, including but not limited to lost revenue, lost or damaged data or economic loss, regardless of the cause of action, arising directly or indirectly with respect to the Website or Content or use of or inability to use the Website or Content. Notwithstanding the foregoing, in the event that CCQTA or its representatives are found liable for damages, such damage shall not exceed $10.00.
7. Trademarks
Names, words, titles, phrases, logos, designs, graphics, icons and trademarks displayed on the Website and used in the Content may constitute registered or unregistered trademarks of CCQTA or third parties who have licensed them to CCQTA. While certain trademarks of third parties may be used by CCQTA under license, the display of third party trademarks on the Website should not be taken to imply any relationship between CCQTA and the owner of the trademarks or to imply that CCQTA endorses the wares, services or business of the owner of the said trademarks.

The Website may contain links to third-party websites. These links are provided solely as a convenience to you and not as an endorsement by CCQTA of the contents of such third-party websites. CCQTA is not responsible for the content of any third-party website, nor does it make any representation or warranty of any kind regarding any third-party website including, without limitation, (i) any representation or warranty regarding the legality, accuracy, reliability, completeness, timeliness or suitability of any content on such third-party websites, (ii) any representation or warranty regarding the merchantability and fitness for a particular purpose of any material, content, software, goods, or services located at or made available through such third-party websites, or (iii) any representation or warranty that the operation of such third-party websites will be uninterrupted or error free, that defects or errors in such third-party websites will be corrected, or that such third-party websites will be free from viruses or other harmful components. While CCQTA may encourage links to a Website, it does not wish to be linked to or from any third-party website which contains, posts or transmits any unlawful information of any kind, including, without limitation, any content constituting or encouraging conduct that would constitute a criminal offense, give rise to civil liability or otherwise violate any local, state, provincial, national or international law, regulation which may be damaging or detrimental to the activities, operations, credibility or integrity of CCQTA or which contains, posts or transmits any information, software or other material which violates or infringes upon the rights of others, including material which is an invasion of privacy or publicity rights, or which is protected by copyright, trademark or other proprietary rights. CCQTA reserves the right to prohibit or refuse to accept any link to the Website, including, without limitation, any link which contains or makes available any content or information of the foregoing nature, at any time. You agree to remove any link you may have to the Website upon the request of CCQTA.
9. Governing Law
These Terms of Use and the use of the Website and Content shall be governed by the laws of the Province of Alberta and you agree to submit and attorn to the exclusive jurisdiction of the Courts of the Province of Alberta.
